Direito à participação da criança nos cuidados em saúde sob a perspectiva dos Direitos Humanos dos Pacientes

Resumen


O presente estudo consiste em pesquisa teórico e documental em que se objetiva analisar a aplicação do direito à participação da criança, previsto no art. 12 da Convenção sobre Direitos da Criança, no âmbito dos cuidados em saúde. Conclui-se que, independentemente da capacidade jurídica da criança para o consentimento informado, sua participação nos seus cuidados em saúde é um imperativo ético-jurídico a ser incorporado à legislação brasileira vigente e à prática cotidiana dos profissionais de saúde.
